Married member's benefit
selection -- Spousal consent required. (1) The member, if
married, must provide the spouse's written consent to the
option selected under WAC 415-110-326. If a married member
does not provide spousal consent, the department will pay the
retired member a joint and one-half survivor benefit allowance
and record the member's spouse as the survivor in compliance
with chapter 41.35 RCW and RCW 41.35.220(2).
(2) Spousal consent is not needed to enforce a marital
dissolution order requiring the department to pay an ex-spouse
under RCW 41.50.790.
(3) "Spousal consent" means that the married member's
spouse consents to the retirement option selected by the
member. The spouse's notarized signature on a completed
retirement application constitutes spousal consent.
